"What is Sexual Harassment? Learn How To Draw The Line" - Prof.M.S.Rao

Currently the cases of sexual harassment are growing rapidly. The media is also getting aggressive by reporting such things often without any cross verification to hit the limelight at any cost for increasing their viewership. Sexual harassment has almost become quite common at the workplace. Let us find out what is and what constitutes sexual harassment.

What is Sexual Harassment?

According to the United Nations General Recommendation 19 to the Convention on the Elimination of all Forms of Discrimination Against Women defines sexual harassment of women to include:

"Such unwelcome sexually determined behavior as physical contact and advances, sexually colored remarks, showing pornography and sexual demands, whether by words or actions. Such conduct can be humiliating and may constitute a health and safety problem; it is discriminatory when the woman has reasonable ground to believe that her objection would disadvantage her in connection with her employment, including recruitment or promotion, or when it creates a hostile working environment." The term sexual harassment has been coined by Dr. Mary Rowe in early 1970s. It has been existing since time immemorial but it has drawn attention recently as the women began working along with men.

Sexual harassment can happen between a man and a woman and between the same sexes. It is a form of abuse and bullying at the workplace where the superior seeks sexual favors for promoting her or giving her both financial and non-financial incentives. However, when a woman sleeps with a man willingly and subsequently if there is any rift in their relations she cannot claim that she was sexually harassed. The victim can be of any gender and the harasser can be of anyone who is a superior or a subordinate, or a colleague, or a client or a stranger.

Sometimes the harassers may not be completely aware of their behavior as an offensive or constitutes sexual harassment. That means, they are ignorant of their misbehavior. Sometimes, misunderstandings in communication might be treated as sexual harassment.

Sexual harassment is cultural and contextual. What is treated as a good behavior might be treated as a bad behavior in other cultures. The term is cultural specific, situational specific and contextual.

Flirting vs. Sexual Harassment:

There is a thin line that separates sexual harassment from flirting. Don’t confuse being friendly or flirtiness as a welcome signal. Flirting is a natural process to be enjoyed with mutual consent but not at the cost of others. Flirting is fine as long as it is healthy, complementary and reciprocal. It should not be at the cost of others’ wishes or sentiments. Flirtation can sometimes boost one’s ego and rejuvenates the lost magic in relationships arising out of pulls and pressures in daily life.

Sexual Harassment Gestures:

Let us look at few gestures that can be treated as sexual harassment. They are:
unwanted physical touch, demonstrating pornography, talking about sex at the workplace, spreading rumors about the relations among the people at the workplace, making sexual advances, seeking for sexual favors, facial expression with sex appeal, unwelcome hugging, kissing, touching and commenting so on.

Body Language and Sexual Harassment:

Research reveals that women are smarter at getting at the vibes of the men than the other way round. They use less of oral language and more of body language to attract men. Woman sends specific signals to reveal her interest towards man. She giggles, laughs, twirls her hair, and maintains cheerful eye contact. This is an indication of her interest in man. However man responds mostly through oral language and preferably by praising her beauty. They are good at hidden data of communication such as recognizing the emotions, feelings and egos than that of men who are only strong at gauging both the verbal and non-verbal communication such as body language.

How To Identify?

At times, it is tough to draw the fine line between misbehavior and sexual harassment. Few women wear ‘provocative dressing’ to get noticed. And if any one questions her provocative dressing, she might get offended thus leveling charges of sexual harassment. Who is to be blamed in this regard? Is it the woman who tempts others with her provocative dressing to get noticed or the person who questions her dressing? Therefore, it is a complicated issue where people find it tough to draw the line. Besides, cultural factors play a crucial role to declare what is offensive, or defensive or proper.

Provocative dress is one of the causes for sexual harassment where others are tempted to tease. Let us look at few more causes for sexual harassment.

Causes:

When both woman and man agree to have relationship it cannot be treated as a sexual harassment. Even courts cannot enter and interfere between consensual relationship. However, the problem arises when a woman complains against man. At times, organizational politics at the workplace may lead to such complaints. Therefore, the authorities have to find out how far the accusation is appropriate and the information is genuine. Whether there was a case of real sexual harassment or was it due to personal egos between two different genders has to be taken into account for coming to conclusion.

It is usual practice to blame the car driver for hitting the pedestrian although the mistake lies with the latter for crossing over the road unmindful of the approaching car and being negligent about the traffic signals. People express their sympathy to the injured person rather than the car driver. Similarly, when any complaint comes from a woman, men are usually targeted immediately. It is unfair to do so. The best thing is to keep gender issue aside and look at the complaints objectively without any gender bias.

In some cases, the woman who is incompetent may harbor jealousy against a colleague who is highly competent and may level the charges of sexual harassment. In such cases, there should not be any sympathy just because the complaint came from a woman.

Sometimes a wicked woman might use it as a weapon to settle her scores with her male colleague at the workplace.

Sometimes there are negative elements such as rumor-mongers who spread rumors to settle their scores with their colleagues due to professional jealousies.

When a woman complains of sexual harassment, it is essential to keep short messaging services through cell phones (smss), email or letter correspondence ready as evidence. The people who have been targeted must be ready with their credentials of commendation and awards to prove their point of good behavior.

Susan and Ron:

Let us take the examples of two employees in an organization. Susan and Ron were working in the same department. Susan was senior while Ron was junior in that organization although Ron was older to Susan in age. Susan did not appreciate the growing popularity of Ron and his superior performance. She harbored professional jealousy. Finally one day, she took Ron to a room and attacked him verbally within the four walls thus insulting his ego. Ron realized the insecure feelings of Susan and kept mum as he respected her as a good colleague. Was it not a sexual harassment by a woman on man? Therefore, sexual harassment is not by men on women alone but by women on men as well. A woman who is superior at the workplace and who is highly dominant might not appreciate her subordinate excelling professionally. In such a scenario she might hurt male ego that can also be treated as sexual harassment.

Sexual Harassment Training:

As prevention is better than cure, it is essential to educate and train employees about the concept of sexual harassment and the dos and don’ts for ensuring healthy workplace environment. Therefore, it is essential for organizations to conduct sexual harassment workshops once in a while. .

Sexual harassment training helps organizations to check the menace. People will be made aware of what is flirting and harassing. At times, people don’t know the difference between the both and cross their lines leading to controversies. It also makes things clear what constitutes and falls under sexual harassment as people often don’t know the clear cut definition of sexual harassment. Sometimes men at the workplace might think that praising the beauty of a woman is a compliment. And the same may be viewed in a different context from the other side. Therefore, sexual harassment training helps educate the employees at the workplace to learn, appreciate and respect the values, cultures ethics and etiquette.

At times people are ignorant of their behavior. They don’t know what is acceptable and unacceptable behavior. Besides, the implications of sexual harassment must be made aware to victims, the harassers, and the organizations through proper training.

Tips to Tackle:

· When you find that a woman or a man at the workplace is a troublemaker, stay away as far as possible. And also when you find that your colleague has professional jealousy and is playing politics, it is better to stay away in totality.
· When someone is approaching you often without any valid reasons with sexual behavior and tendencies, you need to safeguard yourself.
· Keep track with people who often criticize, complain and condemn others. Such people are dangerous elements at the workplace who disturb the healthy atmosphere at the workplace.
· When someone is touching you physically without any valid reason, or paying compliment inappropriately, or staring at you constantly, it is time to pick up the signals and guard yourself from such people.
· Be careful with wicked women at the workplace especially divorced who look for filling their emotional gaps and unfulfilled sexual desires. If the same is not fulfilled and not reciprocated appropriately, they can go to any extent to level charges against their male counterparts. At the same time, be careful with men who are highly aggressive and carry forward unreliable information and spread rumors at the workplace. These men promise more and deliver less.

No employer or superior should withhold professional opportunities of an employee just because the employee did not fall in line with the sexual advances or needs of the employer or superior.

There is a thin line between misbehavior and sexual harassment when something happens between a man and a woman. It depends on the relationship that exists between the man and the woman. If the woman likes the man she might treat it as misbehavior, if she dislikes the man she might call it as sexual harassment. Just because of one or two incidents a person can be dubbed as a harasser and the other person cannot be treated as a victim.

It is advisable to conduct sexual harassment workshops as people will be aware of what is what and what are the dos and don’ts at the workplace. Besides, it takes on the behavioral challenge, arming employees and leaders with the information they need to prevent sexual harassment and the tools that will help them to respond when incidents occur.

It is a fact that sexual harassment against women is on the rise. The organizations should take it seriously and design their policies and procedures accordingly to make the workplace climate healthy, peaceful and pleasant.

To conclude, it is essential to create a harassment-free, positive and respectful workplace for all employees for working in a healthy and peaceful professional ambience. It ultimately builds credibility and brand image for the organization paving the way for organizational excellence and effectiveness.

A woman appears beautiful to someone and might not appear beautiful to another. A person seems to be good for someone and might seem to be bad for another. Why is it so? It is all due to our perceptions. John Keats rightly said, ”beauty lies in the eyes of the beholder.” Similarly what appears beautiful might not be beautiful for others. At the same time, there are certain things that are common and universally accepted. Therefore, the statement, ‘we see the things the way we are!’ is appropriate in few contexts but not in all contexts.

Belief Vs Reality:

Is there any difference between beliefs and reality? The question sounds odd, right! Yes, sometimes what people believe is totally different from reality. Initially people believed that earth was flat, but the reality is that earth is round shaped. There were certain beliefs that have been proved wrong over a period of time when clarified and verified with realities.

Usually we see the world not the way it is but the way we are. It is rightly said that nothing is either good or bad but the thinking makes it so. It is all how we perceive the people and the world around us determines our attitude. All people are good as there are no bad people in this world. At times, the circumstances and experiences make people either good or bad. To state further, no man is entirely good and no man is entirely bad.

What is Perception?

Let us briefly look at the meaning of the word perception in this regard. The origin of the world ‘perception’ is from Latin word, ‘perceptio, percipio’ and that means ‘receiving, collecting, action of taking possession, apprehension with the mind or senses.

It is like perceiving whether the glass is half full or half empty. It is a kind of perception although both statements, ‘glass is half full’ and ‘glass is hall empty’ are correct and convey the reality of the level of water in the glass.

A girl may love a boy. However, the boy may treat the girl as a friend. It is all perceptions. We look at people with different lenses. At times we need to change our lenses as we might be wrong. We often judge people wrong. Therefore, it is essential to take a relook and view things with different lenses.

Perceptions and Conflicts:

Several conflicts arise at the workplace due to improper communication, ego clashes and lack of empathy. It is true that conflicts arise because of different perceptions as well, as people see the same thing from different perceptions leading to conflicts. In this regard, empathy is essential to eliminate conflicts. It is equally essential to crosscheck perceptions as perceptions could be wrong.

People look at the world they would like to view. It could be either from positive perspective or with negative perspective depending on their experiences. At times, past experiences shape perceptions. Therefore, we form our views and opinions and arrive at conclusions based on our past bitter or better experiences.

Conclusion:

Below average individuals emphasize on individuals, average individuals emphasize on issues and above average individuals emphasize on ideas. It is all based on the individual perceptions.

As your attitude determines your altitude, your perceptions determine your personality. We all think constantly. Why should not we think positive rather than negative? Why should not we see the world with optimism rather than with pessimism? Why should not we look at similarities rather than differences to make a difference for the mankind?

Leadership has been changing with changing times and technologies although the basic essence remains the same. With the rising aspirations and expectations of the people and the craving for more participation and collaboration rather than the traditional ‘command and control’ concept, there is need for reinvention of the traditional leadership style.

The 21st century calls for leaders, not bosses. It calls for leaders with managerial skills and abilities who may be called managerial leaders. It calls for leaders who can don multiple hats as per the situation with flexibility. The 21st century leaders are the leaders who wed the best and shed the worst.

Gone are the days where leaders think that they get authority from hierarchical positions. These days, people respect the leaders who have personal power, not positional power.

21st Century Leadership:

The 21st century leadership is a new breed of leadership style where in it takes best of everything that is relevant in the current context but not compromising with the basic leadership principles and values. These leaders must possess unique qualities such as: character, commitment, compassion, communication, servant attitude, setting example, influencing, thinking out of the box, being smart at both soft and hard skills, having vision, cultural competency with a global mindset, radiating energy and enthusiasm, willing to take risk, appreciating similarities but not differences, empathizing with others, being passionate, optimist, and confident, demonstrating flexibility and adaptability to various challenges arising out of changing times and technologies, grooming others as leaders, and above all, passion to make difference for others.

Touchstones of 21st century leaders:

Since 1960s people have been showing lot of interest in leadership as it has been evidenced in the growing interest in these books and articles. Currently there is dearth of leadership talent and potential as it has become clear from several global challenges and crises arising out of recession. In fact, there is need for leadership training and development to churn leaders who can take the current challenges head-on.

Traditional leadership worked under traditional conditions. However, the current conditions demand a leadership that is unique and different. It requires creativity and out-of the box thinking. According to Daniel Pink; the 21st century skills that will be rewarded are "ingenuity, personal rapport, and gut instinct."

21st century leaders must be able to work in a pressurized and political environment. They must lead by example and influence, not control. They must provide clear direction, support and facilitate. They must be ready to change with a creative mindset to solve problems. They must learn to blend and balance between their head and heart, predictability and spontaneity, logic and vision and above all, criticism and forgiveness.

They must possess troubleshooting skills, change management skills, conflict management skills, networking skills, facilitation skills, and storytelling skills. We shall look at the few more touchstones.

• Being proactive.
• Ability to change and effect change smoothly.
• Appreciating similarities, ignoring differences
• Global mindset with universal cultural competency
• Being optimist and confident.
• Being good at Emotional Quotient (EQ), Intelligence Quotient (IQ) and Spiritual Quotient (SQ)
• Problem solving skills and emotional intelligence.

The 21st century leaders must be fair and impartial and flexible to change. They must roll up their sleeves and help others. They must be risk takers and must bring out the best in others, build bridges, lead by example and manage change effectively and efficiently.

Employees’ Expectations:

Employees want to be treated well. They should be treated like partners rather than employees. They like to be groomed as leaders. In addition, they are more concerned about their professional growth.

Therefore, the leaders must build confidence and trust among people that their professional career growth is ensured. Besides, they must demonstrate flexibility and versatility, empower their people, engage employees effectively and efficiently, provide ownership and accountability, lead by example and influence.

Obama – A New Breed of Leader:

When we look at Obama, it is obvious that he is a new breed of leader the people are looking for. People are looking for leaders who can bring about change smoothly. People are looking for leaders who can walk their talk. People are looking for leaders who can transform the society. Above all, people are looking for leaders who can make a difference for others. Therefore, Obama is an apt example of a 21st century leader.

The book titled ‘The Heart of a Leader’ is yet another interesting book from the shelves of Ken Blanchard. The author needs no introduction. He is the author of forty plus books that includes blockbuster international best seller ‘The One Minute Manager’. He is a trustee emeritus of the board of trustees. He was inducted into Amazon’s Hall of Fame as one of the top twenty-five best-selling authors of all time. The book contains excellent quotes with elaborative illustrations and examples. The book unveils the leadership lessons Ken Blanchard learnt throughout his career as a teacher and leader. It equips the tools and techniques to excel as a true leader with a great heart and offers invaluable ideas and insights and emphasizes on ethics and values for achieving excellence.

I have read the book titled ‘The Leader Who Had No Title: A Modern Fable on Real Success in Business and in Life’ (Jaico Publishers) by Robin Sharma, the life leadership specialist and who needs no introduction. The entire book maintains conversational tone with valuable takeaways as the way it happens in the book ‘One Minute Manager’.

The book helps you deliver your best regardless of your hierarchical position. It helps you unlock your hidden talents and leverage the same. It helps you to seize the opportunities. Everybody is a leader from pauper to prince and from peon to principal provided they deliver their best unmindful of their title and designation. “Sri Krishnas and Salyas in Organizations” – By Prof.M.S.Rao

In the Mahabharat epic, at the beginning of Kurukshetra battle between the Pandavas and the Kauravas, Arjun was caught in an emotional dilemma as he had to fight against his relatives, and elderly persons like Bheesma and his Guru, Drona and others. When Arjun lost his motivation then Lord Krishna motivated and explained to Arjun that he was fighting against evil forces and the people who were on the wrong side. Having been persuaded and motivated by Lord Sri Krishna, Arjun fought the battle under the leadership and mentorship of Sri Krishna and finally Pandavas won the battle at the end.

On the other hand, a great warrior like Karna who was highly motivated and who decided to take on battle against his half brother Arjun for the sake of his friend Duryodhana was discouraged by his charioteer, Salya. Throughout the battle Karna was discouraged by Salya, as the latter wanted the victory of Pandavas defeat of Kauravas. Every time when Karna was fighting against Arjun with great motivation, Salya crushed the morale of Karna and ultimately became responsible for the death of Karna and defeat of Kauravas.

When we look at such characters like Sri Krishna and Salya in the Mahabharat epic, it becomes very clear that in organizations also we find such people who motivate the depressed people and take their people to greater heights of glory. In contrast, we also find few people who depress the highly motivated people through negativism and cynicism.

Therefore, it is essential on the part of the organizations to identify the elements who often criticize, condemn and complain against others and who often invalidate others. Such elements are nuisance for others as it hampers the organizational productivity and performance. Employees like Salya are available in all organizations who are the speed brakers and leave the organization in the lurch at the time of crisis. Such Salyas have to be shown the door as they vitiate the organizational culture and climate. To conclude, let us look for Sri Krishnas but not Salyas in our personal, professional and social life to excel as leaders and to come out with flying colors.
